摘要
盱衡我國外送員權益保障及外送平臺管理法雖已就不透明演算法衍生之報酬爭議,定有資訊揭露、定型化契約規制及申訴救濟等規定,惟其要求揭露資訊範圍、透明度及申訴機制顯有不足。本文認為應參照歐盟改善平臺工作之工作條件指令與法院見解,明定平臺業者須揭露演算法之主要參數、權重、程序與原則,並修正舉證責任規定,落實平臺業者對報酬之舉證責任。此外,中央主管機關應詳列定型化契約應記載及不得記載事項,避免平臺外送員遭不當扣減報酬,並透過施行細則定明簡明、可理解原則之操作概念及受理單位資格與權限,俾落實渠等之權益保障。
Abstract
Regarding disputes over remuneration related to opaque algorithmic mechanisms, although Taiwan’s Law on the Protection of Delivery Workers’ Rights and the Management of Delivery Platforms contains provisions on information disclosure, standardized contract regulations, and complaint procedures, the scope of required information disclosure, transparency, and the complaint and remedy mechanisms remain insufficient. Drawing on the EU’s Directive on improving working conditions in platform work and the relevant case law, this article argues that platform operators should be explicitly required to disclose the main parameters, weights, procedures, and principles of their algorithms. Furthermore, rules on burden of proof should be amended to ensure that platform operators bear the burden of proof regarding remuneration determinations. Furthermore, the central competent authority should specify the mandatory or prohibited provisions of standard contracts to prevent improper deductions from remuneration. Finally, the Enforcement Rules should provide operational interpretation of the principle of being “concise and understandable,” as well as clarify the qualifications and authority of the complaint-handling unit to effectively ensure the rights and interests of platform delivery workers.
